End User License Agreement & Terms of Use

1. Acceptance of Terms

By accessing or using AETHER ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time; continued use constitutes acceptance of changes.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into this agreement.

3. License & Ownership

All software, products, and digital content provided through AETHER ("the Products") are licensed, not sold. We grant you a non-exclusive, non-transferable, revocable, personal license to use the Products solely for your own personal, non-commercial purposes.

You acknowledge that all intellectual property rights, including but not limited to copyrights, trade secrets, and proprietary techniques embodied in the Products, remain solely owned by AETHER.

4. Prohibited Conduct

You agree NOT to:

Reverse engineer, decompile, disassemble, or attempt to derive source code from any AETHER Product or service.
Redistribute, resell, sublicense, share, rent, lease, or transfer your license or access to any third party.
Copy, modify, create derivative works, or extract any portion of the Products for any purpose.
Bypass, disable, or interfere with any HWID locking, authentication, or security features.
Use any automated tools, scrapers, or bots to access, extract, or manipulate the Service.
Share account credentials or allow any person other than the registered account holder to access the Service.
Use the Service for any illegal activity or in violation of any applicable law.

Violation of any of these terms may result in immediate termination of your license, revocation of access, and legal action, including claims for damages and injunctive relief.

5. HWID Locking & Account Security

All Products are bound to a unique hardware identifier (HWID) linked to your account. You may not attempt to bypass, modify, transfer, or remove the HWID lock. Each license is valid for one (1) machine only. HWID resets are granted at our sole discretion.

You are responsible for maintaining the confidentiality of your account credentials. Any activity occurring under your account is your responsibility.

6. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for any reason including but not limited to violation of these Terms. Upon termination, your license to use the Products immediately ceases. No refunds will be issued for terminated accounts.

7. Refund Policy

All sales are final. Due to the digital nature of the Products, we do not offer refunds or exchanges once access has been granted. Chargebacks will result in immediate account termination and permanent ban.

8. Disclaimer of Warranties

THE SERVICE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. We are not responsible for any detection, ban, or action taken by third-party platforms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AETHER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR ACCESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Our total liability to you shall not exceed the amount paid by you for the specific Product giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless AETHER, its operators, affiliates, and licensors from any claims, damages, losses, liabilities, or expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada. Any disputes arising under these Terms shall be resolved exclusively in the courts of Quebec, Canada.

We respect the intellectual property rights of others. If you believe any content on our Service infringes your copyright, please contact us with the relevant details and we will investigate promptly.
